The regime for expert evidence adduction via Order 14 of the Singapore International Commercial Court (“SICC”) Rules 2021 involves a nuanced, multi-path track for litigators with anterior consideration of, and confinement to, the approved (i) issues; and (ii) common set of agreed or assumed facts.
How do the Rules operate in practice? A notable recent case decided by Singapore’s apex court in CSDS Aircraft Sales & Leasing Inc v Singapore Airlines Limited (No. 2) [2023] SGCA(I) 5 [“CSDS (No 2)”] has helpfully summarised, and elucidated, instructive principles on expert evidence evaluation. In particular, the Court of Appeal gave insightful comments on the intersection and interplay of factual and expert evidence on assessment of damages.
